As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with. If you are not sure about anything, please contact us.

1. Application
These Terms and Conditions will apply to the purchase of food and beverages by you (the Customer or you) through our Platform. We are Fasteat (UK) Ltd whose trading name is FastEat a company registered in England and Wales under number 09146717 whose registered office is at Kemp House, 125 City Road, London, England, EC1V 2NX with email address (insert contact email address); telephone number 123456789; (FastEat or us or we).
These are the terms on which we provide our services to you. By placing an order, you agree to be bound by these Terms and Conditions. You can only use the Website if you are eligible to enter into a contract and are at least 18 years old.

2. Interpretation
Consumer means an individual placing an order through our Platform for food and/or beverages;
Contract means the legally-binding agreement between you and us for the supply of the Services;
Delivery Location means the Consumer’s premises or other location where the food and beverages are to be supplied, as set out in the Order;
Food and Beverages means any goods that we supply to you with the Services, of the number and description as set out in the Order;
Order means the Customer's order for the Services from FastEat as submitted following the step by step process set out on the Website;
Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website;
Services means the services provided on the Website, including any food and/or beverages, of the number and description set out in the Order;
Website means our website FastEat.co.uk on which the Services are advertised.

3. Our Services
The description of our Services and any Goods is as set out in the Website, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in the size and colour of any Goods supplied.
In the case of Services and any Goods made to your special requirements, it is your responsibility to ensure that any information you provide is accurate.
All Services which appear on the Website are subject to availability.
We can make changes to the Services which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

4. Purpose
The Website and the FastEat (UK) Ltd Services are a third-party marketplace for customers (“Consumers”) to view, discuss, and place orders for food and beverages, and pick- up and/or delivery services in connection therewith, with participating restaurants (the “Restaurants”). FastEat (UK) Ltd provides order placement services only. FastEat (UK) Ltd is not a merchant of food or beverages, or provider of any pickup or delivery services in connection therewith, and does not control the Restaurants or the production of any food or beverages, or any pick-up or delivery
The Restaurants have entered into agreements with FastEat (UK) Ltd to comply with UK laws, rules, regulations, and standards pertaining to food preparation, sale, marketing and safety. FastEat (UK) Ltd, including the Website FastEat.co.uk and the FastEat (UK) Ltd Services, does not in any way independently verify the credentials or representations of any of the Restaurants, the ingredients or the quality of any their products or services, or any Restaurant’s compliance with applicable laws.
Customers using the FastEat (UK) Ltd Services must make themselves comfortable through the information provided by the Restaurants on the Website, by contacting the Restaurants directly, or through such other means or methods as they may deem appropriate, as to the quality and reliability and quality of the Restaurants and the Restaurants’ compliance with applicable laws. FastEat (UK) Ltd, including the Website and the FastEat (UK) Ltd Services, does not in any way guarantee the quality of any Restaurant or any food or beverage, or any pickup- up or delivery service in connection therewith, or any compliance thereof with applicable laws. In addition, a Restaurant may represent certain standards with respect to their food preparation (or other services), such as “organic,” “kosher,” “macrobiotic” or allergen- specific standards such as “nut-free,” “gluten-free,” or “lactose-free”; FastEat (UK) Ltd does not investigate or verify any such representations. FastEat (UK) Ltd shall not be liable or responsible for any food or beverages, or any other services, offered by the Restaurants or any errors or misrepresentations made by them (including on the Website and through the FastEat (UK) Ltd Services).
We do take customer satisfaction very seriously and, in addition to contacting the applicable Restaurant directly, we ask that you notify FastEat (UK) Ltd of all complaints or concerns that you might have regarding the Restaurants.

5. Disclaimers and Limitation of Liability
To the extent permitted by law, FastEat (UK) Ltd provides this Site and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of this Site, or that it will be timely or error-free, that defects will be corrected, or that the Site or server that makes it available are free of viruses or other harmful components.
Subject to the previous paragraph, neither FastEat (UK) Ltd nor any directors, officers, agents, employees or contractors shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use this Site.
Nothing in these terms shall exclude or limits liability for death or personal injury resulting from our negligence or that of our agents or employees.

 

6. Personal information and Registration
When registering to use the Website you must set up a username and password. You remain responsible for all actions taken under the chosen username and password and undertake not to disclose your username and password to anyone else and keep them secret.  You are not allowed to register multiple memberships for use by the same person. Violation of this clause may result in termination of your membership.
We retain and use all information strictly under the Privacy Policy.
We may contact you by using e-mail or other electronic communication methods and by pre-paid post and you expressly agree to this.

7. Placing an Order
FastEat (UK) Ltd endeavours to deal with reputable third parties who provide a quality service, however FastEat (UK) Ltd accepts no responsibility or liability for the quality or quantity of any goods delivered by or collected from said third parties. It is the responsibility of the customer to thoroughly check the supplied goods before agreeing to pay for an order.
All questions regarding goods shown on this Site should be directed to the partner restaurant.
Once you have selected your order from the menu of your chosen Delivery Restaurants you will be given the opportunity to submit your order by clicking on the "proceed" button. Please note it is important that you check the information that you enter and correct any errors before clicking on the "proceed" button since once you click on this input errors cannot be corrected.
On receipt of your payment, FastEat (UK) Ltd will begin processing your order and we will send you notification by SMS text and email that payment has been received and that your order is being processed.
Where any payment you make is not authorised you will be returned to the previous page on the Website and we shall not be obliged to provide the services.
Please note that once you have made your order and your payment has been authorised you will not be able to cancel your order nor will you be entitled to a refund.
Please note that from time to time there may be delays with processing payments and transactions, on occasion this can take up to sixty (60) days to be deducted from your bank account.
Please make sure the email address you provide is correct and your mailbox is in proper working order, as all correspondence regarding your order is sent to this address.
All food preparation and deliveries are the sole responsibility of the restaurant accepting the order. Please be aware that the restaurant will do everything they can to meet the delivery time you specified, however delivery times may be affected by factors beyond their control and therefore cannot be guaranteed. We will inform you if we become aware of an unexpected delay.
Incorrect personal details may lead to problems or delays in delivery, so please ensure that you have included your correct address (including postcode), email address and contact telephone number when ordering.

8. Third Party Payment Gateways
When you place an order through the FastEat (UK) Ltd Services, you will be given a choice of payment options, which may include via Apple Pay, Credit Card, PayPal®, Android Pay, and direct payment to the applicable Restaurant. If you pay for your purchase via Apple Pay, Credit Card, PayPal, or Android Pay, we will ask for a valid Apple Pay account, Credit Card, PayPal account, or Android Pay account, as applicable, which will be billed through the FastEat (UK) Ltd Services, for the purchase price of the applicable order, and “FastEat (UK) Ltd” will be the name that appears on the Apple Pay, Credit Card, PayPal, or Android Pay statement, as applicable. As stated above, however, FastEat (UK) Ltd, including the Website and the FastEat (UK) Ltd Services, is not and shall not in any manner be considered the seller of any of the food, beverages, and services ordered.

9. Basis of Sale
The description of the Goods in our website does not constitute a contractual offer to sell the Goods. When an Order has been submitted through the Website, we can reject it for any reason, although we will try to tell you the reason without delay.
The Order process is set out on the Website. Each step allows you to check and amend any errors before submitting the Order. It is your responsibility to check that you have used the ordering process correctly.
A Contract will be formed for the Goods ordered only when you receive an email from us confirming the Order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing an Order, you agree to us giving you confirmation of the Contract by means of an email with all information in it (i.e. the Order Confirmation). You will receive the Order Confirmation within a reasonable time after placing your Order.  Fees and charges include VAT at the rate applicable at the time of the Order.
You must pay by submitting your credit or debit card details with your Order and we can take payment immediately or otherwise before delivery of the Goods.

10. Refund Policy
FastEat (UK) Ltd takes customer satisfaction very seriously. If you have any problems with your order, please contact FastEat (UK) Ltd and we will do whatever we can to assist you. In appropriate cases, if you have already been billed by FastEat (UK) Ltd, FastEat (UK) Ltd may issue full or partial refunds, or “Cash Coupons”.

11. Intellectual Property
You may not print, copy, reproduce, download, republish, broadcast, transmit, display, modify or re-use the materials from this Site for anything other than personal, non-commercial use, including in particular any purpose which publicly re-sells or re-uses the materials, without the prior written consent of the copyright holder.
All copyright, trademarks and other intellectual property rights in this Site and its content (including without limitation the Site design, text, graphics, logos, icons, images and all software, databases and source code connected with the Site) are owned by or licensed to FastEat (UK) Ltd or otherwise used by FastEat (UK) Ltd as permitted by law.
FastEat and the FastEat logo are trademarks of FastEat (UK) Ltd.

12. Indemnity
You must indemnify and hold harmless FastEat (UK) Ltd, its directors, officers, employees, agents, vendors, advertisers, partners and suppliers and keep them indemnified against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from your Access to and use of this Site, any breach or violation of the Terms of Use of this Site or your violation of any law or your violation of the rights of any third party.

13. Availability
This Site may be unavailable at certain times to allow for maintenance and upgrades. Although we will endeavour to notify customers in advance of any service unavailability, this cannot be guaranteed and we reserve the right to alter or withdraw the service at any time.

14. Third Party Sites
This Site contains links to other websites. Those websites are not under the control of FastEat (UK) Ltd and FastEat (UK) Ltd is not responsible for the practices, content or availability of such websites. A link does not imply endorsement of, sponsorship of, or affiliation with the linked site. We provide the links as a convenience only. If you decide to access linked third party websites, you do so at your own risk, and we will not be held responsible or liable for any loss or damages caused by use of or reliance on any contents, goods or services available on such websites.
You may provide a non-framed link to this Site from any other business or service website but not in any way which gives the impression that we are associated with or have approved such other site, unless expressly agreed to by ourselves in writing.

15. Limitations of Use
This Site is intended to be accessed by persons located in the UK and we make no representation that any information, materials or functions included in this Site are appropriate for use in any other jurisdiction.
By using this Site, you warrant that any personal information provided by you is true, accurate, current and complete in all respects and that you will notify us immediately of any changes to your personal information by updating your member profile on the Site or contacting us.
You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
You may not use the Site for any unlawful or unauthorised purpose, including without limitation:
a)             distributing any unlawful, libellous, abusive, threatening, harmful, obscene or otherwise objectionable material
b)            transmitting material that constitutes a criminal offence, results in civil liability or otherwise breaches any laws, regulations or codes of practice.
c)             Interfering with any other persons use or enjoyment of the Site.
d)            Damaging, disabling or impairing the operation of this Site or attempting to gain unauthorised access to this Site or to networks connected to it, through hacking, spoofing or other such similar means.

16. Circumstances beyond the control of either party
In the event of any failure by a party because of something beyond its reasonable control:
a. the party will advise the other party as soon as reasonably practicable; and
b. the party's obligations will be suspended so far as is reasonable, provided that that party will act reasonably, and the party will not be liable for any failure which it could not reasonably avoid, but this will not affect the Customer's above rights relating to delivery (and the right to cancel below).

17. Feedback and User Submissions
We do not solicit nor wish to receive any confidential or proprietary information from you. Nor do we wish to receive any creative materials, ideas or suggestions other than those we specifically request.
If you do send to us by email or otherwise, any communication or material, you represent and warrant that the information and material is original to you, and you will be deemed to have granted us a perpetual, world-wide, royalty-free license to use such communications or material in any way we see fit and we will be free to use any such material or information contained in communications you send for any purpose whatsoever.

18. Alcohol and Cigarettes
Pursuant to the Licensing Act 1964, it is an offence for any person under the age of 18 to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18. Cigarettes are not for sale to minors under the age of 16. Orders containing either alcohol or cigarettes can therefore not be accepted from minors.

19. Price and Payment
Once your order has been accepted, this represents an agreement between you the customer and the restaurant. The restaurant has sole responsibility for this order. Cash payments are made directly to the restaurant fulfilling the order. If you have chosen to pay with credit or debit card on the Site then the transaction is processed by FastEat (UK) Ltd as an authorised agent of the restaurant.
All orders are subject to acceptance by us, and we will confirm such acceptance when we pass the order to the restaurant or the third-party whose products you have ordered. In the event we decide not to accept your order, we will contact you using the telephone numbers you provided when placing the order, or registering your details when placing your first order. The contract between us will only be formed when we pass the order with the restaurant in question.
During busy periods, some restaurants may choose not to accept orders for deliveries. If this is the case, we will notify you of this using the telephone numbers provided at the time of ordering, as soon as we are told / informed by the restaurant, and we will make every effort to find an alternative / similar member restaurant and will give you the choice to switch your order to that restaurant. Advance orders however may be taken for delivery during kitchen hours. Orders placed at busy restaurant periods will take longer to prepare which will/may affect delivery times. Prices will be as quoted on this Website. These prices include VAT but may exclude delivery costs, which will be added to the total amount due (if you opt for delivery instead of collection), where applicable.
We operate a zero violence tolerance policy, and will not accept any verbal or physical abuse to our staff or drivers. Any such incidents will be reported to the police and will be prosecuted to the maximum extent of the law
This Website contains a large number of menus and it is always possible that some of the menus may be incorrectly priced. If the correct price for an order is higher than the price stated on the Website FastEat (UK) Ltd will normally contact you before the order in question is dispatched. FastEat (UK) Ltd is under no obligation to ensure that the order is provided to you at the incorrect lower price or to compensate you in respect of incorrect pricing.
In the event that you have a complaint about the quality of food or service provided by the restaurants on this Website then any compensation should be sought directly from the restaurant. FastEat (UK) Ltd is not able to provide refunds on behalf of the restaurants and is not liable for any such refunds sought. All complaints must be lodged initially with the restaurant and, where appropriate, the restaurants own complaint procedures followed before FastEat (UK) Ltd is able to respond to a complaint.
A discount may apply to your order if you use a promotional code recognised by this Website and endorsed by FastEat (UK) Ltd.
All prices are inclusive of VAT and quoted in British (Sterling) Pounds.
Delivery and/or card charges are calculated per order and based on the policy of the individual restaurant. Any delivery charges or card fees will be displayed clearly in your Order Summary.
Prices are subject to change and all goods are subject to availability.

20. Amending or cancelling your Order
Once you have submitted your Order and your payment has been authorised, you will not be entitled to change or cancel your Order, nor will you be entitled to a refund (please refer to paragraph 9 “Basis of Sale” for rejected Orders).

21. Exclusion of Right of withdrawal
You have no right to withdraw your food order towards the restaurants, if and when it concerns the delivery of goods, which:
a) are liable to deteriorate or expire rapidly, or
b) are made to the consumer’s specifications or clearly personalized.

22. Termination
We reserve the right to decline a new registration, terminate your right to link to the Site, remove you as a user of this Site, and/or prevent any further use if you violate any of the Terms of Use. If we consider there to be a risk of liability or loss to us or our partner restaurants we may take any action deemed necessary to prevent such a liability or loss from occurring.
If we terminate your right to link to the Site you must cease linking to the Site immediately. Any person who holds a suspended or terminated membership must not order from or re-join this Site without our prior written consent. We reserve the right to assign or sub-contract any or all of our rights and obligations under these terms.
Please note that we have the ability to trace your IP address, and if necessary, contact your ISP in the event of a suspected breach of these Terms of Use.

23. Enforceability
If any part of these Terms of Use are deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any of the remaining provisions of these Terms of Use.
No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision

24.Governing Law
The Contract (including any non-contractual matters) is governed by the law of England and Wales.
Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where the Customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.
If a dispute occurs customers should contact the vendor directly to find a solution. We are a third party provider and do not involve ourselves directly in disputes between consumers and restaurants. 

 

FastEat voucher terms & conditions

General
The following general terms and conditions (the "General Voucher Terms") will apply to all vouchers issued by FastEat from time to time for use on the Website ("Vouchers").

Individual Vouchers will also be subject to, and the General Voucher Terms will be supplemented and/or modified by, additional terms and conditions (the "Specific Voucher Terms") that will be specified on the Voucher or at the time the Voucher is issued.

Vouchers may only be redeemed towards online Orders from Restaurants made through the Website. The code provided with the Voucher is to be entered at the end of checkout process. The final amount owing after a Voucher has been applied will be shown in the checkout basket and any remaining balance must be paid by credit or debit card

Subject to the UK Consumer Law, Vouchers purchased through FastEat cannot be exchanged or refunded, and are valid for such period specified at the time of issue of the Voucher. FastEat reserves the right to cancel any voucher any time without notice. To the extent required by law, including UK Consumer Law, FastEat will provide a remedy if it cancels a Voucher.

Vouchers are not available for redemption at Restaurants that display "Vouchers Not Accepted", and may be valid at other Restaurants only under certain conditions (for example, first time FastEat customers). One gift voucher cannot be used for more than one order and the full amount must be used in one transaction (no change will be given). Alcohol restrictions apply. FastEat reserves the right to charge the value of the voucher to your allotted credit card if we determine that the voucher was redeemed contrary to the terms of use.

The right to use a Voucher is personal to the intended recipient and may not be transferred. No Voucher may be copied, reproduced, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient, or stored in a data retrieval system, without our prior written permission. In particular, Vouchers distributed or circulated without our written approval, for example on an Internet message board or on a "bargains" website, are not valid for use and may be refused or cancelled.

Unless otherwise provided or specified in the Specific Voucher Terms:

Vouchers may not be used in conjunction with other Vouchers or any other discounts or promotions provided or advertised from time to time;

each Voucher will be valid for use by a recipient only once;

each customer or household is limited to one Voucher per promotion or offer; and

the right to use a Voucher is personal to the original recipient and may not be transferred.

When you use a Voucher you warrant to us that you are the duly authorised recipient of the Voucher and that you are using it in accordance with these terms, lawfully, legally and in good faith. If we believe in our sole discretion that a Voucher is being used in breach of these terms, unlawfully, illegally or in bad faith, we may reject or cancel the Voucher.

Vouchers may not be exchanged for cash.

To the extent permitted by law, including UK Consumer Law, we shall not be liable to any customer or household for any loss or claim arising out of the refusal, rejection, cancellation or withdrawal of any Voucher or any failure or inability of a customer or household to use a Voucher.

To the extent permitted by law, including the Australian Consumer Law, we reserve the right, at any time and in our sole discretion, to add to or amend these terms and conditions in relation to the use of Vouchers or to vary or terminate the operation of a Voucher at any time without notice.

All standard terms and conditions from time to time for use of the Website and the Service apply.

FastEat Competition Terms & Conditions

1. The following general terms and conditions (the "General Competition Terms") will apply to all competitions run by FastEat.

2. Individual competitions will also be subject to, and the General Competition Terms will be supplemented and/or modified by, additional terms and conditions (the "Specific Competition Terms") that will be specified in connection with each competition.

3. Competitions are open to individual residents of the United Kingdom aged 18 or over, except employees of FastEat, their associated, affiliated or subsidiary companies, and their families, agents, or anyone connected with the competition.

4. Winners will be responsible for ensuring they are able to accept the relevant prize, as set out and in accordance with these FastEat Competition Terms and any applicable Specific Competition Terms.

5. We reserve the right to redraw a competition winner if the relevant prize is not accepted or claimed within the time period stated in the applicable Specific Competition Terms.

6. Completing and submitting a competition entry form will be deemed acceptance of the General Competition Terms and any applicable Specific Competition Terms.
7. The General Competition Terms and any applicable Specific Competition Terms shall be governed by UK laws.

8. Any personal data that is collected as part of any FastEat competition will be handled in accordance with our Privacy Policy, which is available on www.FastEat.co.uk website.

9. To the extent permitted by UK law, we reserve the right to withdraw any competition at any time without prior written notice and/or to alter or amend the General Competition Terms or the Specific Competition Terms for any competition at any time.

11. All standard terms and conditions from time to time for use of the Website and Service apply.
